Vendors must additionally provide valid business registration documents (GST, PAN, business license) as required.

4. Account Registration and Security

4.1 Account Creation: You must create an account to access certain features. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4.2 Account Termination: We reserve the right to suspend or terminate your account if you:

• Violate these Terms or applicable laws
• Engage in fraudulent or illegal activities
• Provide false or misleading information
• Abuse or harass other users or vendors
• Fail to pay for orders or services

5. Platform Services

5.1 Marketplace: NearbyBazaar operates as an online marketplace connecting buyers with vendors. We:

• Provide a platform for vendors to list products and services
• Facilitate transactions between buyers and vendors
• Process payments through authorized payment gateways
• Coordinate delivery through logistics partners
• Provide customer support and dispute resolution

5.2 Disclaimer: NearbyBazaar is NOT:

• The seller or manufacturer of products listed by vendors
• Responsible for the quality, safety, or legality of products/services
• A party to the contract between buyers and vendors
• Liable for vendor actions, product defects, or delivery delays

6. Orders, Pricing, and Payments

6.1 Order Placement:

• All orders are subject to vendor acceptance and product availability
• Prices are displayed in Indian Rupees (INR) and include applicable GST
• Shipping charges, if any, will be displayed before checkout
• We reserve the right to refuse or cancel orders for any reason

6.2 Payment Methods:

• Credit/Debit Cards (Visa, Mastercard, RuPay)
• UPI (Google Pay, PhonePe, Paytm, BHIM)
• Net Banking
• Wallets (Paytm, Amazon Pay, Mobikwik)
• Cash on Delivery (COD) - where available

6.3 Payment Processing:

• Payments are processed securely through RBI-authorized payment gateways
• We do not store your complete card details on our servers
• Payment confirmation is sent via email and SMS
• Refunds are processed as per our Refund Policy

7. Shipping and Delivery

7.1 Delivery Timeline:

• Estimated delivery times are provided by vendors and may vary
• Delivery times are not guaranteed and may be affected by unforeseen circumstances
• You will receive tracking information once the order is shipped

7.2 Delivery Address:

• Ensure your delivery address is accurate and complete
• We are not responsible for delays due to incorrect addresses
• Signature may be required upon delivery
• Undelivered packages will be returned to the vendor

8. Returns, Cancellations, and Refunds

8.1 Return Policy:

• Returns are accepted within 7 days of delivery (unless otherwise specified)
• Products must be unused, in original packaging, with tags intact
• Certain products (perishables, personalized items) are non-returnable
• Return shipping costs may apply

8.2 Cancellation Policy:

• Vendors may cancel orders due to stock unavailability

8.3 Refund Policy:

• Refunds are credited to the original payment method
• COD orders are refunded via bank transfer or UPI

9. Vendor Terms

9.1 Vendor Obligations: Vendors agree to:

• Provide accurate product descriptions, images, and pricing
• Maintain adequate stock levels and update availability
• Ship orders within the committed timeline
• Comply with all applicable laws (GST, consumer protection, product safety)
• Respond to customer inquiries and resolve disputes promptly
• Not sell counterfeit, illegal, or prohibited products

9.2 Commission and Fees:

• NearbyBazaar charges a commission on each sale (as per vendor agreement)
• Payment gateway fees are deducted from vendor payouts
• Vendor payouts are processed within 7-15 days after delivery confirmation

10. Prohibited Activities

You agree NOT to:

• Violate any laws, regulations, or third-party rights
• Sell or purchase illegal, counterfeit, or prohibited items
• Engage in fraudulent transactions or payment manipulation
• Post false reviews or manipulate ratings
• Scrape, copy, or misuse Platform content without permission
• Interfere with Platform security or functionality
• Harass, abuse, or threaten other users or vendors
• Use the Platform for money laundering or terrorist financing
• Create multiple accounts to abuse promotions or discounts

11. Intellectual Property Rights

11.1 Platform Content:

• All Platform content (logo, design, text, graphics) is owned by NearbyBazaar
• You may not copy, reproduce, or distribute Platform content without permission
• Trademarks and brand names are property of their respective owners

11.2 User Content:

• You retain ownership of content you upload (reviews, photos, comments)
• By uploading content, you grant NearbyBazaar a non-exclusive license to use, display, and distribute it
• You warrant that your content does not infringe third-party rights

12. Disclaimers and Limitation of Liability

12.1 Platform "As Is":

• The Platform is provided "as is" and "as available" without warranties of any kind
• We do not guarantee uninterrupted, error-free, or secure access
• We are not responsible for third-party content, products, or services

12.2 Limitation of Liability:

• NearbyBazaar is not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the specific transaction
• We are not liable for vendor actions, product defects, or delivery delays
• We are not responsible for losses due to unauthorized account access

13. Indemnification

You agree to indemnify, defend, and hold harmless NearbyBazaar, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any laws or third-party rights
• Your use of the Platform or services
• Content you upload or submit
• Disputes with other users or vendors

Any disputes not resolved through customer support shall be settled through arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English in Multai, Madhya Pradesh, India.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any legal action or proceeding arising out of these Terms shall be subject to the exclusive jurisdiction of the Civil Court in Multai, Madhya Pradesh, Pin Code 460661, India.
